Abstract

The civil judge is considered the cornerstone in upholding justice and protecting rights within society, as his role is manifested through the effective management of judicial proceedings in accordance with the powers granted by law. His functions vary across the stages of litigation, beginning with the preparatory phase and culminating in the issuance of judgment.In the preparatory stage, the judge undertakes the task of organizing the case and defining its scope by hearing testimonies, conducting inspections, and seeking the assistance of experts when necessary. He also evaluates the significance of the evidence presented and directs the parties towards clarifying the dispute and expediting the proceedings. This role is not limited to procedural aspects, but rather aims to establish a solid foundation for fair adjudication.During the trial stage, the judge’s broader role emerges, as he is required to manage hearings with impartiality, listen to pleadings, interrogate the parties, and confront witnesses with questions necessary to uncover the truth. At this point, the judge must apply the law to the facts in a balanced manner, reconciling the legal texts with the spirit of justice, while ensuring the right to defense and the principle of adversarial proceedings.Nevertheless, the authority of the judge is not absolute; it is subject to precise legal and ethical constraints. The first is the principle of judicial conviction, which allows the judge freedom in forming his conviction when assessing evidence, yet within the bounds of legal reasoning. He is also bound by the presumption of innocence, which prohibits attributing fault or liability without conclusive proof. Furthermore, the principle of judicial impartiality remains the most crucial safeguard, requiring the judge to distance himself from bias or external influence, thereby ensuring fairness between the litigating parties, strengthening public trust in the judiciary, and maintaining the stability of judgments.
