The process of balancing rights and freedoms and the public interest is one of the most important issues that the constitutional legislator is concerned with, because of the violation of this balance resulting in prejudice to the rights and freedoms of individuals, especially with regard to the aspect of criminal law, because this law has an urgent and direct relationship with the safety and freedoms of individuals and their money. And the damages resulting from breaching these issues to their lives and moneyAnd that the legislator surround them with sufficient guarantees that prevent domination or abuse and abuse of the legislative or executive authority during the application of laws, especially in the field of our research related to criminal law, both substantive and procedural. As an effect of these constitutional principles, the achievement of criminal legal security.
