The stability of the judiciary is not achieved by the issuance of judgments, but by the integrity of the legal basis on which those judgments are based, especially if they are issued by the highest judicial body in the country, as the Federal Court of Cassation is supposed to draw the correct judicial direction and unify the legal interpretation in order to achieve legal security and prevent the disruption of judicial applications. However, this does not preclude the subjection of its provisions to scientific criticism whenever they are inconsistent with the lack of adaptation or exceeding the limits of the applicable legal texts.
