Abstract

Through this research, it becomes clear to us that the rules of banking secrecy contained in legislation, in particular the Iraqi legislation, are insufficient alone to protect the information and electronic customer data in banks due to the great development witnessed by trade in general and e-commerce in particular, and in order to attract the investor, the quality of banking services provided by banks, especially electronic to keep pace with the rapid changes in the world of trade and economy, must be improved.

Therefore, legislation in most countries sought to organize and develop a certain system to protect this information, which is called information security, which must work in tandem with the rules of banking secrecy to attract investors as a result of this protection guaranteed by legislation and as a result of its reassurance on its information and data that represent its accounts and banking operations, the greater the confidence in the banking sector, the more this leads to activating the movement of commercial and economic life of countries.

As far as the Iraqi legislator is concerned, the text on the rules of banking secrecy has been contained in many legislations, foremost of which is the constitution, in addition to the laws of Labour, Penalties and Banks, and the Iraqi legislator stipulated the second axis complementary to this protection, which is the security of information in the law of Electronic Signatures and  Transactions  No. 78 of 2012, as well as the electronic payment services system No. 3 of 2014, and this indicates something, it indicates the legislator's awareness of the importance of this information and its role in the development of The banking and economic sector in general, If protected and surrounded by sound legal rules that ensure a safe banking environment for the investor.
