يُعد تأمين الغذاء من الواجبات المهمة التي يجب على الدولة القيام بها؛ لما للغذاء من مكانة مهمة لدى الانسان ولأنه العنصر الأساسي في الحفاظ على حياته، وتعمل الدول من أجل تحقيق ذلك وحماية حق الانسان في الأمن الغذائي على تضمين هذا الحق في نصوص قانونية سواءً كانت دستورية أو تشريعات عادية مستندة في ذلك الى بعض المصادر الدولية، أو الإقليمية الخاصة بحقوق الانسان؛ لأن الحق في الأمن الغذائي يندرج من ضمن الحقوق الاقتصادية التي تضمنها العهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية، وأنْ تعمل الدول على حماية هذا الحق من تأثير بعض العناصر أو العوامل التي يمكن تحول دون تمكين الافراد من إعماله، مثل: العناصر السياسية وعدم الاستقرار في هذا المجال، وعناصر الطبيعة مثل: التغير المناخي والتصحر، والعناصر الديموغرافية المتمثلة بزيادة اعداد السكان والتوسع العمراني على حساب الاراضي الزراعية بشكل لا يتناسب مع ما موجود من المواد الغذائية لذا: على الدولة القيام بواجبها في حماية وضمان تمكين الافراد من التمتع والحصول على حقوقهم ومنها الحق في الأمن الغذائي وتأمينه بالكميات التي يحتاجها.
