Abstract

Children of unknown parentage represent a large segment of society that suffer
from Denigration and are treated with inferiority. They are eliminated from society
due to abandonment by their parents for reasons such as the lack or religious faith,
poverty, adultery, or wars, which resulted in an ill treatment, dehumanization, and
degradation of children of unknown parentage. Rearranging the social and legal
position of children with unknown parents is considered a socio-legal issue that
puzzles legal scholars and sociologists.
The most serious problem, however, manifest in the absence of a legal
regulation that governs the actions of the guardian of a child with unknown parent.
The provisions of Guardianship is not expressly detailed in one law. Moreover,
there are no legal rules that comprehensively address the affairs of children of
unknown parentage in Iraq, only sub-texts in many laws, each of which deals with
an aspect of the child of unknown parentage.
